These Terms of Service (“Terms”) govern your use of the kField mobile application, the kField Sync QGIS plugin, the kFieldCloud web service, and any related software or documentation (collectively, the “Service”) provided by kCube Consultancy Services Pvt. Ltd. (“kCube”, “we”, “us”), a company incorporated in India. By creating an account, installing any kField component, or using the Service in any way, you (“you”, “Customer”) agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
kField is a field data-collection stack for organisations that already use the QGIS desktop GIS platform. It comprises:
- The kField mobile app for Android, used by field officers to capture features (points, lines, polygons), photos, and audio notes — on or off the network.
- The kField Sync QGIS plugin, used by GIS operators to package projects for the field and to synchronise captured data back into QGIS.
- The kFieldCloud hosted web service that stores projects and synchronises data between desktop, mobile, and the cloud.
kField is enhanced and maintained by kCube on top of the open-source QField, QFieldSync, and QFieldCloud projects originally created by OPENGIS.ch (see §9).
2. Eligibility & Account
You must be at least 18 years old and authorised to bind your organisation to these Terms. You agree to provide accurate registration information and to keep it current. You are responsible for safeguarding your credentials and for all activity under your account.
3. Pricing, Billing & Refunds
Paid plans are billed per active field officer per billing period (monthly or annual, as selected). Prices, included quotas, and overage rates are stated on the kField website or in the order form you sign with us. Fees are exclusive of applicable taxes (including GST in India).
All fees are due in advance for the upcoming billing period. We may suspend or terminate accounts with overdue balances after written notice. Pre-paid annual fees are non-refundable except where required by law. You may cancel renewal at any time before the next billing date.
4. Customer Data & Intellectual Property
You retain all right, title, and interest in the geographic features, attributes, photos, audio recordings, and any other content you or your users submit to the Service (“Customer Data”). You grant kCube a worldwide, non-exclusive, royalty-free licence to host, store, transmit, back up, and process Customer Data solely as necessary to operate the Service for you.
kCube and its licensors retain all rights in the Service software, the kField name and logo, and any feedback you provide (which we may use without obligation). “QField”, “QFieldCloud”, “QFieldSync”, and “QGIS” are names of products owned by their respective projects and may be protected as trademarks of their owners. They are used in these Terms and elsewhere on this site purely descriptively, to credit the upstream open-source projects on which kField is built. No claim of ownership, sponsorship, or endorsement by OPENGIS.ch or the QGIS project is implied.
5. Acceptable Use
You agree not to:
- Use the Service to violate any law, regulation, or third-party right;
- Upload material that infringes intellectual property, breaches privacy, or contains malware;
- Attempt to gain unauthorised access to other accounts, networks, or systems;
- Reverse-engineer, decompile, or disassemble closed-source kCube components, except to the extent expressly permitted by applicable law;
- Use automated means to extract bulk data beyond your own organisation’s scope;
- Resell, sublicense, or otherwise redistribute the hosted Service to third parties without our prior written consent.
The open-source components of kField may be redistributed in accordance with their respective licences (see §9).
6. Service Availability & Support
kCube strives to keep the kFieldCloud service available 24×7 but does not guarantee uninterrupted operation. We may perform planned maintenance after reasonable notice and respond to incidents on a best-effort basis. Customers on a paid plan that includes a Service Level Agreement (SLA) will receive the SLA terms separately. Support requests may be sent to kfield@kcubeconsulting.com.
7. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
8. Suspension & Termination
We may suspend or terminate your access to the Service immediately if (a) you materially breach these Terms; (b) we are required to do so by law; or (c) your use threatens the integrity or security of the Service. Upon termination, you may export your Customer Data within 30 days; after that period we may delete it.
9. Open-Source Licences
kField incorporates and depends on the following open-source projects, the use of which is governed by their respective licences (which take precedence over these Terms in case of conflict regarding those components):
- QField — the mobile collection app, by OPENGIS.ch, licensed under the GNU General Public License version 2 or later (GPL-2.0-or-later). The original source is available at github.com/opengisch/QField.
- QFieldSync — the QGIS plugin, by OPENGIS.ch, licensed under the GPL. The original source is available at github.com/opengisch/QFieldSync.
- QFieldCloud — the cloud server, by OPENGIS.ch, licensed under the MIT License. The original source is available at github.com/opengisch/QFieldCloud.
- QGIS — the desktop GIS, by the QGIS project, licensed under the GPL. Available from qgis.org.
Source code for kCube’s GPL modifications. The complete corresponding source for the kField mobile app and the kField Sync QGIS plugin — including every kCube modification — is published under the same GPL-2.0-or-later licence at:
- github.com/kcubeconsulting/kfield-mobile — kField Android app source
- github.com/kcubeconsulting/kfield-sync — kField Sync QGIS plugin source
Upstream QFieldCloud is licensed under the MIT License and does not impose a corresponding source-distribution obligation on kCube’s server-side modifications.
Use of the Service does not grant you any trademark rights in “QField”, “QFieldSync”, “QFieldCloud”, “OPENGIS.ch”, “QGIS”, “kField”, or “kCube”. You may fork the open-source code freely under the relevant licences, but you may not present such forks as kField or kCube products without our written permission.
10. Warranty Disclaimer
To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including (without limitation) merchantability, fitness for a particular purpose, accuracy, or non-infringement. The open-source components disclaim warranties as set out in their respective licences.
11. Limitation of Liability
To the maximum extent permitted by law, kCube’s aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. In no event will kCube be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if advised of the possibility.
12. Indemnification
You agree to indemnify and hold harmless kCube and its directors, employees, and contractors from any third-party claim arising out of (a) your Customer Data, (b) your breach of these Terms, or (c) your violation of applicable law.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts located in Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or related to these Terms.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email or in-product notice at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
